What to do when you get sued !
Your increasingly hostile adversary has just served you with ‘court papers’. Depending on the Court or Tribunal, those ‘papers’ likely contain a ‘Statement of Claim’ or ‘Application’.
Your first thought – Get a Lawyer! The first thought of your appointed lawyer should be - Jurisdiction!
Just because a Court or Tribunal has issued a claim against you, that does not mean that they have the authority to do so. Further, even with the authority, that Court or Tribunal may not be the proper forum.
Therefore, with a proper application, you could win (with costs) against your adversary. This can be despite you having a factually and legally weaker case.
A win due to a ‘technicality’ is still a victory. It is often even sweeter than when the narrative favours you.
